1. Agreement and eligibility
These Terms of Use (“Terms”) form a binding agreement between you and Vietpik for use of vietpik.com and related account, content and trip-planning features. By accessing or using Vietpik, you agree to these Terms and the Privacy Policy. If you do not agree, do not use the service.
You must be legally able to enter this agreement and satisfy the minimum age required where you live. If you use Vietpik for an organization or business, you confirm that you are authorized to bind it.
2. What Vietpik provides
Vietpik is an information, discovery and personal planning platform. Unless Vietpik expressly states otherwise, Vietpik is not a travel agency, tour operator, ticket seller, restaurant, accommodation provider, insurer, payment provider or agent of a listed business. Saving a place, adding a stop or publishing a trip does not create a booking, reservation, guarantee or contract with a third party.
Features may change, be limited, tested or discontinued. We may correct errors and need not preserve a feature indefinitely, but we will use reasonable care with stored user data.
3. Accounts and security
Provide accurate account information, protect your credentials and keep contact details current. You are responsible for activity under your account unless caused by Vietpik’s breach of duty. Tell us promptly about suspected unauthorized use.
We may require verification, reject confusing or impersonating names, revoke sessions, limit features, or suspend an account when reasonably necessary for security, moderation, compliance or service integrity. Accounts and access rights may not be sold or transferred without written permission.
4. Travel information and personal responsibility
Places, menus, prices, hours, transport, admission, events, weather, visa information, health information and accessibility details can change. Content may be illustrative, translated, incomplete or based on sources that later change. Confirm material information with the responsible provider or official authority before relying on it. Unknown prices remain unknown and estimates are not quotations.
You decide whether a destination, activity, meal, route or expense is appropriate. Consider law, entry requirements, licensing, weather, health, allergies, insurance, local instructions and your own ability. Vietpik does not provide medical, legal, immigration, financial or safety advice and does not guarantee that a trip is safe or suitable.
5. Your content and licence to Vietpik
You retain ownership of content you submit. You grant Vietpik a worldwide, non-exclusive, royalty-free, transferable and sublicensable licence to host, store, reproduce, adapt for formatting or translation, moderate, publish, display, distribute and promote that content solely in connection with operating, improving and marketing Vietpik and its content. The licence lasts while the content is available and for a reasonable period in backups, audit records and prior promotional materials.
You authorize Vietpik to use the submitted display name with public content and, where law permits, waive or agree not to assert moral rights only to the extent needed for the licensed uses. You may request removal, but removal does not undo lawful prior use or records Vietpik must retain.
6. Content standards and your promises
You promise that you have the rights and permissions needed for everything you submit; your factual claims and reviews are honest to the best of your knowledge; and your content does not violate law, privacy, confidentiality, intellectual property or another person’s rights. Reviews must reflect a genuine experience and disclose a material incentive or relationship.
- Do not submit unlawful, threatening, hateful, sexually exploitative, fraudulent, defamatory or dangerously misleading content.
- Do not upload personal documents, payment-card data, malicious code, hidden trackers or private information about another person.
- Do not manipulate ratings, create fake accounts, buy reviews, scrape at scale, evade access controls or interfere with the platform.
- Do not use Vietpik content or user data to build a competing database, train a model, identify individuals or send unsolicited marketing without written permission or another lawful basis.
7. Moderation and enforcement
Vietpik may review, label, edit for formatting, restrict, reject, unpublish or remove content and may preserve evidence of abuse. We may act on reports, automated signals, legal requests or our own review, but we do not promise to monitor every item or resolve every dispute. Publication is not an endorsement.
We may warn, limit, suspend or terminate access for breach, risk, inactivity, security or legal reasons. Where appropriate and lawful, we will consider context and allow an explanation or appeal through support.
8. Business listings and ownership requests
A listing does not imply a commercial relationship or endorsement. A business owner may propose changes or request management, but Vietpik may require evidence, reject a request, preserve editorial independence and display reliable public information. Claiming a listing does not create ownership of Vietpik’s page, ranking, reviews or compiled data.
Businesses must not pressure users, offer undisclosed incentives for reviews, suppress honest criticism or submit misleading prices, menus, events or credentials.
9. Vietpik intellectual property
Vietpik’s software, design, logo, brand, original editorial content, taxonomies, compilations and platform materials are owned by Vietpik or its licensors and are protected by applicable law. Subject to these Terms, Vietpik gives you a limited, revocable, non-transferable, non-exclusive licence to use the service for personal travel planning or authorized internal business management.
No licence is granted to copy the interface, remove watermarks or notices, mirror substantial content, use the Vietpik name or logo, or commercially exploit the service without written permission.
10. Third-party services and links
Maps, OAuth, email, analytics, media delivery and external destination links may be provided by third parties. Their terms and privacy practices apply to their services. Vietpik is not responsible for a third party’s availability, transaction, statement, product, injury, loss or failure. Resolve bookings and payments directly with the provider you chose.
11. Disclaimers
To the maximum extent permitted by law, Vietpik is provided “as is” and “as available”. We disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted availability and accuracy. We do not warrant that user content is truthful, that a listed place is open, or that a route, event, price or recommendation will meet your needs.
Nothing in these Terms excludes a warranty or responsibility that applicable law does not allow us to exclude.
12. Limitation of liability
To the maximum extent permitted by law, Vietpik and its owners, personnel, contractors and suppliers will not be liable for indirect, incidental, special, consequential, exemplary or punitive loss; lost profits, data, goodwill or opportunity; travel disruption; third-party conduct; or personal decisions made from platform content.
For claims arising from the service, our aggregate liability will not exceed the greater of the amount you paid Vietpik for the service during the twelve months before the event giving rise to the claim or USD 100, unless applicable law requires a different amount. These limits allocate risk and apply regardless of the legal theory, but do not limit liability that cannot lawfully be limited.
13. Your responsibility to Vietpik
To the extent permitted by law, you will defend, indemnify and hold Vietpik harmless from third-party claims and reasonable costs arising from your unlawful use, your content, your business submission, or your breach of these Terms or another person’s rights. This does not require you to indemnify Vietpik for Vietpik’s own unlawful conduct. Vietpik may control the defense of a covered claim and you will reasonably cooperate.
14. Changes, termination and survival
We may update these Terms to reflect service, risk or legal changes. Material changes take effect after reasonable notice when required; continued use after the effective date constitutes acceptance where lawful. You may stop using Vietpik at any time and request account closure.
Clauses that by nature should survive— including licences for prior use, intellectual property, disclaimers, liability limits, indemnity, dispute terms and audit retention—continue after termination.
15. Governing law and disputes
These Terms are governed by the laws of Vietnam, without regard to conflict-of-law rules, unless mandatory consumer law in your country applies. Before filing a claim, you and Vietpik agree to make a good-faith attempt for at least 30 days to resolve it through the contact page.
Subject to mandatory law, disputes that are not resolved informally will be submitted to the competent courts of Vietnam. You may also have a right to bring a claim or complaint before the authority or court required by non-waivable local law.
16. General terms and contact
If part of these Terms is unenforceable, it will be adjusted only as much as necessary and the remainder continues. Delay in enforcement is not a waiver. You may not assign this agreement without permission; Vietpik may assign it in connection with a restructuring or transfer of the service. Neither party is liable for delay caused by events beyond reasonable control, subject to duties that cannot be excused.
